Terms & Conditions
Effective Date: July 2026
These Terms & Conditions form the agreement between Swan Valley Marriage Office ("we", "us", "our") and the couple ("you", "your") booking our marriage celebrant services.
By paying the lodgement fee, you acknowledge that you have read and agree to these Terms & Conditions.
1. Booking Your Ceremony
Your ceremony date and time are not secured until:
-
your booking enquiry has been accepted;
-
the required $250 lodgement fee has been received; and
-
we have confirmed your booking in writing.
2. Lodgement Fee
A non-refundable lodgement fee of $250 is required to secure your ceremony date and time.
The lodgement fee covers:
-
reserving your ceremony date;
-
commencement of planning and administration;
-
communication and preparation;
-
lodging of Notice of Intended Marriage documentation and marriage paperwork preparation.
The lodgement fee is non-refundable.
If your ceremony is postponed, the lodgement fee may be transferred provided:
-
Swan Valley Marriage Office is notified as soon as possible;
-
the new ceremony date is within 12 months of the original booking date;
-
the new date meets all legal marriage requirements and timeframes; and
-
Swan Valley Marriage Office is available on the requested date.
If we are unavailable on your preferred new date, the lodgement fee remains non-refundable.
3.Final Payment
The remaining balance is due one month (30 days) before your wedding date.
If payment has not been received by the due date and no alternative arrangement has been agreed to in writing, Swan Valley Marriage Office reserves the right to cancel the booking.
The lodgement fee remains non-refundable.
4. Cancellation by the Couple
If you decide to cancel your ceremony, written notice must be provided as soon as possible.
The $250 lodgement fee is non-refundable.
Where final payment has already been made, any refund will be assessed after deducting:
-
services already provided;
-
administration completed;
-
legal documentation prepared;
-
any non-recoverable expenses incurred.
5. Rescheduling
We understand that circumstances sometimes change.
If you need to postpone your ceremony, every effort will be made to accommodate a new date.
Transfers are subject to:
-
availability;
-
legal marriage timeframes;
-
the new ceremony taking place within 12 months of the original booking.
Additional travel or venue charges may apply if the new location differs from the original booking.
6. Cancellation by Swan Valley Marriage Office
In the unlikely event that we are unable to conduct your ceremony due to illness, injury or unforeseen circumstances, every reasonable effort will be made to arrange another authorised Commonwealth-registered marriage celebrant.
If a suitable replacement cannot be arranged, any payments made for services not provided will be refunded.
Our liability is limited to the amount paid for the services booked.
7. Legal Requirements
Under Australian law, couples are responsible for providing all required legal documentation.
You agree to:
-
lodge the Notice of Intended Marriage within the legal timeframe;
-
provide acceptable identification;
-
provide evidence of the end of any previous marriage (where applicable);
-
advise us of any changes to your personal details;
-
ensure two witnesses aged 18 years or over attend the ceremony.
Failure to provide legally required documentation may prevent your marriage from proceeding.
8. Delays
If your ceremony is significantly delayed due to circumstances beyond our control, we will make every reasonable effort to accommodate the revised timing.
However, where another booking or prior commitment exists, the ceremony may need to be shortened or alternative arrangements discussed.
9. Force Majeure
Neither party is responsible for delays or cancellations caused by circumstances beyond reasonable control, including but not limited to:
-
severe weather;
-
bushfires;
-
floods;
-
government restrictions;
-
pandemics;
-
venue closures;
-
natural disasters;
-
power failures;
-
other emergencies.
Where possible, both parties agree to work together to reschedule the ceremony.
10. Photography & Social Media
We love celebrating our couples.
With your permission, photographs from your ceremony may be used for:
-
our website;
-
Facebook;
-
Instagram;
-
other promotional material.
No images will be used where you have requested privacy.
Your preferences will always be respected.
11. Privacy
Your personal information is collected solely for:
-
managing your booking;
-
preparing legal marriage documentation;
-
communicating with you;
-
complying with Australian marriage laws.
Your information will never be sold or shared with third parties except where required by law or necessary to complete your marriage registration.
12. Intellectual Property
All content appearing on the Swan Valley Marriage Office website, including text, photographs, logos and branding, remains the intellectual property of Swan Valley Marriage Office unless otherwise acknowledged.
No material may be copied, reproduced or used without written permission.
13. Limitation of Liability
Nothing in these Terms & Conditions excludes or limits any rights or remedies available under the Australian Consumer Law.
To the extent permitted by law, Swan Valley Marriage Office is not liable for indirect or consequential loss arising from circumstances beyond our reasonable control.
14. Governing Law
These Terms & Conditions are governed by the laws of Western Australia and the Commonwealth of Australia.
Any disputes will be subject to the jurisdiction of the courts of Western Australia.
